Academic User Agreement

Academic User Agreement

All terms below are part of the general Academic User Agreement. Academic use of the FitMáx© questionnaire and algorithm requires no charge, but an Academic User Agreement is mandatory for each study.

The FitMáx© development team grants permission to USER to employ the FitMáx© questionnaire and algorithm in the academic study/research mentioned during the process.

Use of the FitMáx© questionnaire and algorithm in the mentioned investigation is subject to the following conditions:

  • USER confirms that the study/research is being conducted without direct or indirect sponsorship or support, financial or not, from pharmaceutical, medical appliance, or related for-profit company or similar. Furthermore, no future for-profit use, direct or indirect, of the data generated is allowed under this agreement.
  • USER will grant the FitMáx© development team limited access to the trial database. Access will be limited to the following:
    • (a) FitMáx© questionnaire and algorithm data
    • (b) additional data will be made available to the FitMáx© team at the sole discretion of USER as deemed appropriate for the purpose of validation of the FitMáx© questionnaire and algorithm.
  • USER will not modify, abridge, condense, translate, adapt, or transform the FitMáx© questionnaire, algorithm, or associated scoring methods in any manner or form, including but not limited to any minor or significant change in wording or organization.
  • USER will not reproduce the FitMáx© questionnaire, algorithm, or scoring methods except for the limited purpose of generating sufficient copies for its own use and shall in no event distribute copies to third parties by sale, rental, lease, lending, or any other means.
  • Reproduction of the FitMáx© questionnaire or algorithm as part of any publication is strictly prohibited. The FitMáx© questionnaire, algorithm, manuals, and associated measures are copyrighted by the FitMáx© development team.
  • USER shall in no event distribute or share data generated using the FitMáx© questionnaire and algorithm with the intent of making a profit or enabling a third party to profit from the data. Distribution or sale of such data will be subject to a separate agreement (if so, please contact fitmax@mmc.nl for inquiries).
  • Analysis and reporting of data from the FitMáx© questionnaire and algorithm by USER will follow the written guidelines provided in the FitMáx© Scoring Manual.
  • The FitMáx© team grants permission to USER to migrate the FitMáx© questionnaire and algorithm into an electronic device for the purpose of the investigation. The migration and administration of the questionnaire and algorithm electronically is the responsibility of USER, and the FitMáx© team cannot be held responsible for the quality control of the electronic versions or their measures. The user is responsible for ensuring the technical and proper functioning of the electronic version.
  • In case of non-compliance with these terms, the FitMáx© development team reserves the right to take legal action, including but not limited to seeking damages and revoking the usage rights.
  • This agreement holds for the mentioned registered study/research only. Use of the FitMáx© questionnaire and algorithm in any additional studies by USER will require a separate agreement, initiated through a new request.
  • Any disputes arising from this agreement will be submitted to the competent court in the Netherlands.

Commercial User Agreement

All terms below are part of the general Commercial User Agreement.

Why do I need to pay a license fee?

The FitMáx© questionnaire and algorithm are copyrighted instruments, with all rights reserved. Written, prior consent of the FitMáx© development team is required for their use. To employ the FitMáx© questionnaire and algorithm, we ask you to sign a User Agreement, without which permission cannot be granted. Such usage entails a compensation fee payable to FitMáx©, contributing to ongoing research and the enhancement of healthcare initiatives.

What will the fee be used for?

The funds generated from fees will be exclusively used to support non-profit scientific research and the refinement of tools related to the FitMáx© questionnaire and algorithm, ensuring their continued development and validation.

What is included in this fee?

  • The FitMáx© questionnaire
  • Any specific algorithm or modules required for your study
  • Scoring manuals and algorithm scoring support for the requested modules (if applicable)
  • All available languages in our library

What information is required to set up a User Agreement (for my study)?

The following details are needed:

  • Protocol Number, if applicable
  • Title of your study, if applicable
  • The number of patients/users
  • Name and title of the authorized representative who will sign
  • Full company name and address for the User Agreement
  • Full company address for invoicing
  • Department and/or contact name for invoices
  • Email for invoices
  • VAT Number (Europe only – VAT is charged only in the Netherlands, but it is a legal requirement to provide this information where applicable)
  • EPRO – Will the study migrate the questionnaire and algorithm to an electronic device? (Necessary for inclusion of the permission clause in the agreement): Yes/No
  • Specific modules required, if any
  • Required languages
  • Purchase Order Number, if required by your company
  • Name, address, and telephone number of the individual to receive hard copies via courier for wet ink signature, if needed (FitMáx© requires either a wet ink original for filing).
